    Eake from this what you will,the way i read it,it depends if the canal becomes part of a harbour....

    s 10 12 s 10A
    Canals Act 1958
    in Council hereinbefore referred to in this section is registered in the
    registrar’s office.
    10 Consequences of connection of canal with tidal water
    (1) On and from the time when a canal is connected with any tidal
    water—
    (a) if that tidal water is within the limits of a harbour—that canal
    shall become and be included in and form part of that harbour;
    and
    (b) if that tidal water is not within the limits of a harbour—that canal
    shall become and be included in and form part of that tidal water;

    and all of the provisions of the Transport Infrastructure Act 1994 and the
    Transport Operations (Marine Safety) Act 1994 shall apply and extend to
    such canal subject, however, to all such modifications and adaptations
    thereof as are necessary to give operation and effect to this Act.
    (1A) However, where an act or omission constitutes an offence both
    under this Act and under any other Act mentioned in subsection (1), the
    offender may be prosecuted and punished under either this Act or the other
    Act in question but so that the offender is not twice punished for the same
    offence.
    (2) Any right of navigation belonging to or enjoyed by the public over
    tidal water shall, subject to this Act and the other Acts mentioned in
    subsection (1), extend to the tidal water in any canal.

    thats just plain hard to understand alot easier to fish till you get kicked out lol you're fishing in water noone should be able to kickyou out or tell you otherwise just my opinion

    Sanctuary cove is covered by the Sanctuary Cove Resort Act 1985, a special piece of legislation by the Bjelke Peterson government for the Gold Coast white shoe brigade. It's a special place for special people. I don't claim to understand the legal speak but there is something on page 172 as a start

    Spade there are security cameras on all entries off the river, if you got away with an hour you were very lucky, they must have been busy elsewhere, I've never lasted more than 10 minutes

    shouldn't be saying this but go in there at 330-4 fish till 530ish an bail when the residents start waking up obviously its alot easier in a kayak then boat an alot stealthier - they will only come if a resident calls up

    Its just a piss off when your intensions are to release your catch after a quick photo of course and everyone there is under the impression your on some mad fish killing frenzy.Security are just obstacles you need to avoid to get to your target.Can be fun playn cat and mouse when the fishings crap

    Thanks Chris, but you've been lucky, I've been told to leave every time I've gone in. And might I say I've had several run in's with them in the river, which they have no power over as long as you don't touch a pontoon or go ashore.

    Unfortunately guys you are in effect fishing in closed waters,which the forum can't be seen to encourage,even if we agree it shouldn't be a problem as its catch and release.JMO.
